Hajj and Umrah Laws from Loans at Banks

Assalamu’alaikum warahmatullah.

ana want to ask whether someone can go hajj and umroh by using bank loan for civil servants or private employees who have a fixed monthly salary? For his explanation ana said Jazakallahu.

Among the requirements of a person to go to Hajj is to have the ability to go there. An indebted person basically includes a person who does not have the ability unless he or she has paid off the debt or has been tolerated by the person or party who gave him the loan for the delay of payment of the debt until after the pilgrimage.

The word of Allah swt:

ولله على الناس حج البيت من استطاع إليه سبيلا

Meaning: “Hajj is the duty of man to Allah, That is for those who are able to travel to Baitullah.” (Surat Al Aimron: 97)

Narrated by al Baihaqi from Abdullah bin Abi Aufa said, “I asked the Messenger of Allah (PBUH) about a person who has not performed Hajj or owes for Hajj? He said, ‘No.’ “(HR Baihaqi)

Likewise, the debt that the settlement has just occurred in the future and the payment is taken from the deduction of salary or regular pernghasilan per month regularly then basically it is not a barrier for him to hajj. Whether the debt is not related to the ONH, such as: vehicle installment, mortgage or other debt as well as for ONH itself.

However, if a person for the cost of going on a hajite loan from a conventional bank applying the practice of ribawi then it includes cases that are not allowed even though he has the ability to make payments per month from deductions his salary.

Imam Muslim narrated from Jabir he said, “Rasulullah saw cursing usury, those who enjoin usury, his scribes and his witnesses.” He said, “They are all the same.”

And what he did was help please help or help in disobedience and sin that is forbidden Allah Almighty.

ولا تعاونوا على الإثم والعدوان واتقوا الله

Meaning “And do not help-help in sinning and transgression. And fear ye Allah. “(Surah Al-Maidah: 2)
